    Terms and conditions related to acceptable use of service and facilities

    Service Provider Identification

    Services marketed under the WizHosting brand are provided by WIZ IT S.A.S., hereinafter “WizHosting”. These Terms and Conditions govern the contracting and use of the services, together with the specific characteristics and conditions informed and accepted upon contracting. No provision limits rights that are non-waivable under applicable law.

    1 – Content

    Services contracted with WizHosting.com must be used exclusively for lawful purposes. Any use of WizHosting.com services that violates regulations applicable to the service and the activity carried out is strictly prohibited. While using the services, the customer may not disclose or transmit illegal, abusive, defamatory, racist, or offensive content; publish, transmit, reproduce, distribute, or exploit information or software containing viruses or other harmful components; use non-original (pirated) software or materials; infringe intellectual property rights; or use the service to facilitate unauthorized access, credential theft, unlawful exploitation of vulnerabilities, license circumvention, or other activities infringing third-party rights. This restriction does not inherently prohibit educational content or lawful cybersecurity activities performed with proper authorization. Any unlawful use may result in suspension without prior notice. To report abuse, contact contacto@wizhosting.com.

    2 – Service denial, suspension or termination

    WizHosting may refuse an order on objective grounds related to service availability, inability to validate required data, founded indications of fraud, or incompatibility of the requested use with service terms. In case of breach of these terms, WizHosting may restrict or suspend the affected service. When remediable and absent an emergency, the customer will be informed of the reason and given a reasonable timeframe to cure. Grave or repeated breaches may lead to contract termination under applicable law. WizHosting may intervene without prior notice when necessary to contain malware, phishing, active spam, unauthorized access, severe impact to infrastructure or third parties, or to comply with a competent authority order. It will seek to limit intervention to affected services/content where technically feasible and sufficient. The customer will be informed as soon as possible, barring legal impediments. Suspension does not in itself imply permanent deletion of data. Prior to scheduled deletion upon service conclusion or non-urgent breaches, WizHosting will inform the customer of the scheduled date and a reasonable means to retrieve data where legally and technically possible. Data is not kept indefinitely after termination. Urgent file security actions are also governed by section 4. When terminating an indefinite relationship on commercial or operational grounds not attributable to the customer, WizHosting will notify with reasonable advance notice to enable migration. Such decision does not allow overriding an already contracted fixed term nor retaining fees for unrendered services. To validate accounts and prevent fraud, WizHosting may request pertinent info and use specialized providers under its Privacy Policy. Verifications will be proportional. If an order is rejected after receiving payment, refund will be processed without unjustified delay.

    3 – Programs and scripts

    On accounts with execution permissions, the customer may install and run scripts. WizHosting.com may disable any script or software that affects server performance or other clients. All user-installed software must have a valid license. Upon verifiable notice from a rights holder or founded indications of unauthorized use, WizHosting may request proof of licensing. Barring urgency or an order requiring immediate action, reasonable opportunity will be given to provide proof or remove the software. Free and open source software may be used under its license without requiring purchase receipts when inapplicable.

    4 – File distribution

    Shared web hosting plans are intended for website operation and expressly included services. Unless explicitly permitted, they may not be used as external storage repositories, mass file distribution platforms, or backup storage for computers or external systems. The presence of images, documents, audio, videos, or archives does not by itself constitute a breach; relevance to the site and adherence to storage and bandwidth quotas will be evaluated. Upon incompatible usage, WizHosting may request adjustment, propose a suitable plan, or apply measures under section 2. No automatic reactivation fine applies. Extraordinary out-of-scope work requires prior notice and acceptance.

    Disk space usage

    Hosting disk space is dedicated to files and databases necessary for the site, its content, and included services (including mailboxes within contracted quotas). Message age does not determine improper use. Shared hosting may not be used as personal cloud storage, PC backup depot, exported external mail archives, or non-site content. Temporary maintenance/migration copies must stay within quota and be removed when no longer needed. Proportional technical verifications may be carried out. Non-dangerous non-compliant files will receive reasonable notice before deletion. Immediate malicious threats may be isolated or removed to protect infrastructure. Storage rules herein do not automatically apply to VPS, dedicated servers, or specialized products which follow their own specifications.

    5 – Bandwidth usage

    Unless explicitly marked as unlimited, each plan includes a monthly traffic allowance. If the limit is exceeded, we will notify the primary contact email. For frequent overages, upgrading the plan is recommended to avoid service throttling or blocks.

    6 – Hosting contract

    Contracted features include all characteristics and conditions informed at contracting, including applicable promotional offers, alongside obligations under applicable law. After placing an order, the customer has 7 days to complete payment. Offline payments must be reported with proof via client area or email to comercial@wizhosting.com.

    Service cancellation

    Customers may request cancellation from their client area, via the “BOTÓN DE BAJA DE SERVICIO” (Service Cancellation Button) on the website, or enabled electronic channels. They may choose immediate termination or termination at period end. Reasonable identity checks may apply without imposing undue barriers. Cancellation is not conditional upon prior debt settlement or mandatory notice period. Lawfully accrued amounts prior to effective date may be claimed separately, without cancellation penalty fees. No contradictory subsequent renewals or charges will occur. A unique tracking ID is communicated within 24 hours of receipt, and formal legal certification issued within statutory timeframes. Account closure communication states service and effective date. Eligible refunds follow service terms and applicable regulations.

    7 – Confidentiality

    WizHosting maintains confidentiality of personal data and customer information accessed during service delivery, applying appropriate security measures and limiting access to authorized personnel and necessary providers under its Privacy Policy. Customer breach does not waive personal data confidentiality.

    7.1 – Personal Data Protection and Privacy Policy

    Personal data processing is governed by Argentine Law 25.326 and applicable regulations. The Privacy Policy identifies data controller, purposes, recipients, international transfers, retention, and channels to exercise access, rectification, update, and deletion rights. Where the EU GDPR applies, recognized rights (restriction, portability, objection) are honored. Inquiries may be submitted via our Privacy Policy.

    8 – Data loss and backups

    Where automated backups are included, WizHosting performs them per informed plan frequency and retention. Backup inclusion in one plan does not imply identical terms across all products. Backups represent point-in-time snapshots and do not constitute real-time continuous replication. Restoration utility depends on snapshot timing and data state. Customers must maintain independent external backups of critical data, especially prior to major changes. This does not waive WizHosting's contractual backup obligations or liability for attributable breach. In the event of an incident affecting committed backups, WizHosting will promptly inform affected customers and carry out recovery actions within contractual and statutory duties. Absolute disclaimer of liability is not established.

    9 – Domain transfer delays

    WizHosting.com is not responsible for delays in domain registrations or DNS transfers caused by third parties or by the customer.

    9.1 – Registration and management of .COM.AR and .AR domains

    9.1.1. Registration modalities

    WizHosting offers customers two alternatives:
    • Direct registration by the customer through NIC Argentina (www.nic.ar), using their own tax ID and TAD credentials, or
    • Requesting WIZ IT S.A.S. (hereinafter “WizHosting”) to manage registration before NIC Argentina as administrative intermediary.
    When managed by WizHosting, the domain is registered under WIZ IT S.A.S.'s account and tax information before NIC Argentina.
    • The registered owner before NIC Argentina is WIZ IT S.A.S.
    • WizHosting administers the domain on the customer's behalf within contracted service boundaries.
    The customer acknowledges that under this modality:
    Prior to order confirmation, prominent notice is given that WIZ IT S.A.S. will appear as registered owner, along with usage terms and procedure/costs for future transfer to the customer.

    9.1.2. Benefits and scope

    By choosing managed registration through WizHosting, the customer acknowledges:
    • Initial registration does not require direct handling in TAD/NIC Argentina. Subsequent transfer to customer ownership requires meeting NIC Argentina access/identification requirements.
    • Centralizes hosting and domain billing in one account.
    • Includes domain administrative and technical guidance within NIC Argentina platform possibilities.
    Registration approval and processing times depend exclusively on NIC Argentina. WizHosting commits diligent handling once data and payment are received, and prompt notification of relevant notices.

    9.1.3. Hosting exclusivity and DNS delegation

    Domains managed under this modality must be hosted on WizHosting services.
    • DNS delegation to third-party hosting requires prior ownership transfer to customer's NIC account.
    • Any request to point to third-party hosting requires initiating transfer of ownership.
    • The customer acknowledges this commercial condition at purchase.
    Consequently:
    Hosting exclusivity is a commercial condition of this WizHosting modality, not a NIC Argentina rule. It does not limit transfer rights under section 9.1.6. Using an external DNS provider (such as Cloudflare) while primary hosting remains with WizHosting does not constitute third-party hosting, subject to technical compatibility.

    9.1.4. Trademarks and ownership disputes

    The customer declares and warrants that:
    • The requested domain does not infringe trademark or third-party rights.
    • They possess all necessary rights and authorizations to use the domain.
    Upon verifiable claims, NIC dispute, or official order, WizHosting may request documentation and take proportionate protective steps. Absent emergency or legal impediment, customer will be given opportunity to respond. A claim does not automatically validate complainant rights or authorize domain forfeiture. Ownership actions follow lawful procedures without automatic exclusion of refunds.

    9.1.5. Processing times and review procedures

    Registrations and renewals follow NIC Argentina procedures. Names subject to manual review or documentation requirements may experience processing delays. Manual review of names is distinct from special zone enablement (which applies only to specific restricted extensions). Delays solely attributable to NIC Argentina where WizHosting acted diligently will not be imputed to WizHosting, without waiving liability for its own delays. WizHosting communicates relevant notices and configures DNS promptly upon clearance.

    9.1.6. Ownership transfer to customer

    The customer may request transfer of domain ownership to their own NIC Argentina account at any time, provided:
    • Domain is active without renewal debts with NIC.
    • No judicial, administrative, or dispute restrictions exist.
    • Transfer is not prohibited by NIC rules (including post-expiration grace periods).
    Customer must provide valid CUIT/CUIL, active TAD/NIC account, comply with any specific extension requirements, and confirm recipient details in writing.
    • Contar con CUIT/CUIL válido (o ID de usuario en el caso de no residentes, según normativa de NIC).
    • Tener usuario operativo en Trámites a Distancia (TAD) y/o en NIC Argentina asociado a dicho CUIT/CUIL.
    • Cumplir las habilitaciones o requisitos adicionales que NIC Argentina exija efectivamente para la extensión o el trámite concreto. Una revisión manual del nombre de dominio no implica por sí sola que deba habilitarse una zona especial.
    • Confirmar por escrito a WizHosting los datos que NIC requiera para la transferencia (CUIT/CUIL, razón social o nombre completo, correo asociado, etc.).
    Once verified:
    • WizHosting initiates transfer from its NIC Argentina account to customer identity.
    • Customer accepts transfer in TAD/NIC and pays official NIC tariff directly to NIC.
    WizHosting will inform status and timeframe for its actions. NIC tariffs are paid by customer. WizHosting only applies an administrative fee if informed and accepted at original contracting. No unilateral fee will be introduced upon transfer request.

    9.1.7. Transfer timing

    Under NIC Argentina rules, transfer constitutes a new annual registration from completion. Customer should evaluate current expiration while avoiding last-minute delays, as grace periods block transfer. Advance planning is recommended.

    10 – Payments and due dates

    Base service currency is USD, unless an offer specifies otherwise. When local currency payment is available, conversion reference and timing will be informed before purchase. Consumer prices in Argentina are displayed in ARS inclusive of applicable taxes, alongside net price without national taxes where required by law. Unpaid services may be temporarily suspended until renewal payment is confirmed.

    10.1 – Due dates and notifications

    Customers are responsible for timely payment according to due dates informed at purchase and visible in the client area.

    Automatic reminders are sent as a courtesy; non-receipt or spam classification does not waive timely payment duties.

    Customers may verify pending invoices at any time in mi.wizhosting.com.

    Unpaid services are subject to suspension. This does not exempt WizHosting from required economic notifications, nor treat identified received payments as overdue.

    11 – Anti-SPAM policy

    Customers agree not to transmit unsolicited commercial email. Violations allow immediate suspension, without prejudice to claiming provable damages lawfully attributable to the breach. Uninformed automatic fees will not be applied.

    12 – Anti-Phishing policy

    WizHosting.com actively combats phishing. Report suspected abuse via mi.wizhosting.com > Contact.

    13 – Uptime guarantee

    For shared hosting, WizHosting guarantees 99.9% monthly network and server infrastructure availability. Availability is computed deducting computable downtime minutes from total monthly minutes. Scheduled maintenance with reasonable notice, legal force majeure, and customer-side application errors are excluded. Customers may request review via support tickets with available technical logs.

    14 – Commercial refund guarantee and statutory right of withdrawal

    30-Day Commercial Guarantee. Applicable exclusively to initial purchase of shared hosting plans within 30 calendar days via ticket or electronic channels. Excludes VPS, dedicated servers, domains, SSL, and add-ons. Statutory Right of Withdrawal (Right of Retraction). In distance consumer contracts under Argentine Law 24.240 art. 34 and Civil and Commercial Code, consumers may revoke acceptance within 10 calendar days. May be exercised via the “BOTÓN DE ARREPENTIMIENTO” (Withdrawal Button) on the website or electronic channels with unique tracking ID provided within 24 hours. Commercial guarantee is complementary to and does not restrict statutory withdrawal rights.
    Statutory 10-Day Withdrawal: You can exercise your right of withdrawal via commercial ticket.

    15 – Promotions and Discounts

    Promotions and discounts may be offered exclusively for new accounts. Eligibility conditions, validity, discount scope, and renewal terms are informed in each promotion prior to purchase.

    16 – Terms update and Jurisdiction

    These terms are governed by the laws of the Argentine Republic. Future revisions apply to prospective orders. Changes for renewals or ongoing contracts must be communicated in advance via durable medium and require valid contractual mechanisms. For non-consumer disputes where jurisdiction selection is valid, parties submit to the ordinary courts of Córdoba, Argentina. Mandatory consumer protection venue rules are respected.

    17 – Migration Policy

    Complimentary migration includes WordPress sites, static HTML/CSS/JS websites, and full cPanel-to-cPanel accounts. Other platforms require prior technical evaluation and may incur additional fees.

    18 – Radio Streaming Services and Copyright

    Radio streaming and audio services provide technical transmission infrastructure and do not include music or content licensing. Customers are solely responsible for obtaining necessary licenses and authorizations for broadcast content. WizHosting does not exercise prior editorial control but may intervene upon founded claims or legal requirements under section 2. Exemption from WizHosting's own obligations or automatic forfeiture of refund rights is not established.

    19 – Technical support scope and authorized contacts

    19.1. Included technical support scope

    Included technical support covers incidents related to contracted services and guidance on basic configuration and operation, within the administration level defined for each plan. It includes checking access, availability, control panel, and email services where included in the plan. Third-party application issues (such as desktop email clients) are initially reviewed to determine whether root cause lies with WizHosting service. Problems belonging to customer hardware or third-party software are referred to customer IT or covered under optional support.

    19.2. Account owner and authorized technical contacts

    Unless specific terms state otherwise, technical assistance is centralized in the account owner and up to two designated additional technical contacts per account. Limits apply per client account, not per mailbox, domain, device, or employee. The account owner may designate or update contacts via client area or support ticket with reasonable verification. Sharing personal credentials is not required. Administrative or billing users do not automatically expand individual IT support coverage. Support authorization does not confer authority to cancel services or transfer domains.

    19.3. Individual desktop assistance and excluded tasks

    Support does not act as customer internal IT helpdesk for all employees. It excludes individual mail configuration on employee workstations/phones, remote desktop intervention, operating system/printer maintenance, or custom coding. This does not exclude providing standard connection parameters, guides, and migration included in the plan.

    19.4. Ticket organization

    Inquiries regarding a single incident should be maintained within a single ticket. Duplicate requests may be consolidated. If requests arrive from unauthorized staff, WizHosting may request the account owner to centralize communications. No monthly ticket quota or punishment for basic questions applies.

    19.5. Additional services

    Out-of-scope tasks and extended assistance may be quoted separately. Scope and price must be agreed upon prior to billable work. Unagreed automatic charges or fines will not be applied.

    19.6. Security and rights exercise

    Security, abuse, or downtime alerts will be received from any informant and escalated technically without revealing account data to unauthorized parties. Technical contact limits do not restrict consumer claims, cancellation, withdrawal, or privacy rights requests.
